Abstract

Objektif utama kajian ini adalah mengkaji pandangan sarjana kolonial British terhadap Malay Digest,
iaitu Manuskrip Hukum Kanun Pahang. Manuskrip ini merupakan bukti undang-undang Islam
telah dijadikan dasar pemerintahan bernegara di Tanah Melayu. Penulisan ini menggunakan kaedah
analisis kandungan terhadap komentar sarjana kolonial terhadap Manuskrip Hukum Kanun Pahang.
Hasilnya, beberapa perkara utama dapat dikenal pasti. Pertama, sarjana kolonial seperti William
Marsden, Thomas Stamford Raffles, Winstedt dan Richard J. Wilkinson gagal mengulas tentang isu
Islam yang terkandung dalam Manuskrip ini. Kedua, sarjana kolonial memberikan paparan buruk
tentang undang-undang Islam dengan matlamat untuk memperkenalkan undang-undang British di
Tanah Melayu. Ketiga, kajian ini mendapati bahawa pengamalan Islam dalam masyarakat Melayu
Pahang silam adalah berbentuk syumul yang merangkumi seluruh kehidupan bermasyarakat sama
ada dalam bidang pentadbiran, kekeluargaan, jenayah, muamalah, politik dan sebagainya.

The main objective of this study is to examine the views of British colonial scholars on the Malay
Digest, namely the Pahang Coded Law Manuscript. This manuscript is proof that Islamic law has
been made the basis of the state government in Malaya. It uses content analysis on the comments of
colonial scholars on the Manuscript of the Pahang Coded Law. As a result, we identified several key
points. First, colonial scholars such as William Marsden, Thomas Stamford Raffles, Winstedt, and
Richard J. Wilkinson failed to comment on the Islamic issues contained in this manuscript. Second,
colonial scholars gave a negative view of Islamic law with the aim of introducing English law in
Malaya. Third, this study found that the practice of Islam in the Malay community of Pahang in the
past was in the form of ‘syumul,’ which covers the entire community’s lives, whether it is in the field
of administration, family, crime, muamalah, politics and so on.
