Abstract

Islam is a religion that emphasises peace, well-being, and prosperity in human life. In line with this principle, the implementation of Shariah criminal punishments aims to preserve public interest (maṣlaḥah). In Malaysia, the Shariah Criminal Offences Enactments were formulated to address issues related to Shariah crimes. The maximum penalty for Shariah criminal offences, including those related to faith deviation, is three years’ imprisonment, six strokes of whipping, and a fine of RM5,000. However, the alarming issues related to faith deviation, including the emergence of various movements that threaten the faith of Muslims such as the New Age Movement, indicate the need to re-examine the effectiveness of these punishments. This study aims to evaluate expert consensus on the achievement of Maqāṣid al-Sharīʿah in the implementation of the maximum punishment regarding faith deviation. The Fuzzy Delphi method was employed, involving 20 expert informants and one element consisting of six items. The findings show a consensus that the existing punishments do not meet the objectives of Maqāṣid al-Sharīʿah. This includes offences related to faith deviation. The experts reached a consensus that the punishments are too lenient to effectively prevent such crimes.
